New process allows US Virgin Islanders to amend gender designation on official documents

Governor Albert Bryan Jr. (D) of the United States Virgin Islands has signed Executive Order No. 543-2025, creating a formal process for US Virgin Islands residents to request changes to the gender marker on government-issued identification documents.

The order directs agencies, including the US Virgin Islands Department of Health’s Office of Vital Statistics and the Bureau of Motor Vehicles, to update gender designations upon request, allowing residents to hold identification that reflects their true identity.

“Virgin Islanders have reached out to our administration seeking a way to have their documents reflect who they truly are,” Bryan said. “This Executive Order provides a fair and compassionate process where none existed before. It ensures that our government recognizes and respects the lived realities of all our residents.”

Before this action, the territory lacked any formal mechanism for gender marker changes. A prior legislative proposal introduced by the Bryan-Roach Administration, which would have required a court order, did not advance in the 36th Legislature. The new executive order addresses that gap by establishing a clear administrative pathway.

Under the order, individuals aged 18 or older—or parents or guardians acting on behalf of minors—can request a gender marker change in writing. The application must include either:

  • A statement from a licensed healthcare provider confirming that the change is appropriate, or
  • A judicial order from the US Virgin Islands or another jurisdiction approving a gender change.

Once approved, the relevant agency will issue updated identification documents. The revised IDs will use the term “gender” rather than “sex.”

Bryan emphasized that the change brings the US Virgin Islands in line with at least 25 states, Puerto Rico, and the District of Columbia, which already have similar administrative procedures for birth certificates and driver’s licenses.

“Our administration remains committed to fairness, dignity, and respect for every Virgin Islander,” Bryan said. “This Executive Order brings the Virgin Islands in line with modern standards of inclusion and ensures that all residents have access to accurate and affirming government identification.”

Residents seeking more information can contact the Office of Vital Statistics or the Bureau of Motor Vehicles to request a gender marker amendment.
